The legal basis of data protection can be found in the Basic EU Data Protection Ordinance (hereinafter GDPR) and in the Federal Data Protection Act (BDSG).
“Personal data” includes all information relating to an identified or identifiable natural person; a natural person is regarded as identifiable, if he/she can be directly or indirectly identified, especially by means of association with an identifier such as a name, with an identification number, with location data, with an online ID or with one or several special features reflecting the physical, physiological, genetic, psychic, economic, cultural or social identity of that natural person.
"Processing" is any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
The purpose of the processing operation
We use the IP address for the purposes of operational security and online marketing. We also include various third-party services and content on our website, such as videos from YouTube, maps from Google Maps, RSS feeds or graphics from other websites. The integration always presupposes that the third party providers of this content observe the IP address of the users. Without the IP address, the content could not be sent to the user's browser. The IP address is therefore necessary in order to display this content. We make every effort to use only such content from those third parties who use the IP address only for the delivery of the content. However, we have no influence on whether the third party providers also store the IP address for other purposes, e.g. for statistical purposes or marketing purposes. In addition, the integration of third-party content may result in data transfer to countries outside the EU. As far as we are aware of this, we will explain it to you in detail.
The legal basis for processing the IP address is Art. 6 para. 1 of the GDPR. Our legitimate interest in collecting data follows from the fact that we need the IP address for the purpose of operational security and online marketing.
If you enter personal data via fields on our website and send it to us, the purpose of data processing depends on the respective form. If you use our contact form, we will use your personal data to process your request. With regard to registration for our newsletter or participation in competitions, we refer to section 6 of this data protection declaration.
The legal basis for data collection is Art. 6 para. 1 a and f of the GDPR. Our legitimate interest in data collection within the meaning of Art. 6 para. 1 f GDPR follows from the fact that we cannot process your request (contacting or newsletter) without your data. We also use your data to optimize our offers.
Duration of processing
We continuously store the IP address to optimise our offers. If it is no longer needed for this purpose, it will be deleted immediately. We store the data entered via the web forms for as long as we need it to process your request. If you unsubscribe from our newsletter, your data will be made anonymous.
For communication and security reasons, the following data, which the user's Internet browser transmits to the provider or his web space provider, are collected during the visit to the website (so-called server log files):
- Browser type and version
- Operating system in use
- Website from which the user has switched to the website of the provider (referrer URL)
- Website visited by the user
- Date and time of access
- the user's Internet Protocol (IP) address
The data is also temporarily stored. This data is not stored together with other personal data of the user. The legal basis for temporary storage of data is Art. 6 para. 1 It. f GDPR on the basis of legitimate interest in improving the stability, functionality and security of the website.
The data will be deleted after seven days at the latest. Data whose further storage is required for evidence purposes are excluded from deletion until the relevant incident has been finally clarified.
If IP addresses and movement data are processed by third parties using cookies, we have no influence on the duration of processing.
Voluntary provision of data
The following notes are about our newsletter, its content and procedures regarding registration, distribution and statistical evaluation. They also explain your right to appeal. By subscribing to our newsletter, you agree to receive the newsletter and to the procedures described.
Content of the newsletter: We send newsletters, e-mails and other electronic notifications containing advertising information (hereinafter "newsletters") only with the express consent of the recipient or with legal permission. If registration for the newsletter involves a concrete description of its content, then this description is the basis on which the user agrees to receive the newsletter. In addition, our newsletters contain information on legal topics, especially in the field of marketing law, data protection and our law firm (this may include references to blog articles, lectures or workshops, our services or online appearances).
Double-Opt-In and Logging
The registration for our newsletter takes place via a so-called double opt-in procedure. This means that upon registration, you will receive an email requesting confirmation of the subscription. The confirmation is required to ensure that no one else can subscribe using your email address.
A record of subscriptions to the newsletter is kept to fulfil the legal requirements for recording the subscription process. The record contains the time of subscription and confirmation as well as the relevant IP address. Changes to your data stored with MailChimp are also logged.
Use of the "MailChimp" distribution service
The newsletter is sent via "MailChimp", a newsletter distribution platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA.
The e-mail addresses of our newsletter recipients, as well as their further data described in the context of these notes, are stored on the servers of MailChimp in the USA. MailChimp uses this information to send and evaluate the newsletter on our behalf. Furthermore, MailChimp can use this data along with its own information to optimise or improve its own services, e.g. to technically optimise the sending and presentation of the newsletter or for business purposes, in order to determine from which countries the recipients originate. However, the service does not use the recipient data of our newsletter to approach recipients directly, nor do they pass the information on to third parties.
Subscription details: To subscribe to the newsletter, simply enter your e-mail address.
Optionally, we ask you to enter your first and last name. This information is only used to personalise the newsletter. Furthermore, we ask you also optionally to indicate your business field and country. We only use this information to adapt the contents of the newsletter to the interests of our readers.
Statistical surveys and analyses
Performance measurement - the newsletters contain a so-called “web beacon”, i.e. a pixel-sized file, which is retrieved from the email marketing server when opening the newsletter. During the download, technical information such as your browser and operating system, as well as your IP address and the time of the download, are collected. This information is used for technical improvement of the service, as technical data or target group data can be analysed according to their reading behavior, their download locations (identifiable through IP addresses) or download times.
Statistical data collection also includes an analysis of when the newsletters are opened and which links are clicked upon. Although this information technically allows the tracking of individual newsletter recipients, we are not interested in watching the behaviour of individual users. Data analysis is used to recognize patterns in the reading behaviour of users, and to adapt contents accordingly or send different content according to the interests of our users.
Online access and data management
Cancellation/Revocation - You can cancel your subscription to our newsletter at any time, i.e. revoke your consent. At the same time your consent to the newsletter's dispatch via MailChimp and the statistical analyses expires. A separate cancellation of either the dispatch via MailChimp or the statistical evaluation is unfortunately not possible.
You will find an "unsubscribe" link at the end of each newsletter.
Legal basis of the General Data Protection Regulations
In accordance with the provisions of the General Data Protection Regulations (GDPR) valid from 25 May 2018, we inform you that the consent to the sending of e-mail addresses is on the basis of Art. 6 Para. 1 It. a, 7 GDPR and § 7 para. 2 n. 3 and 3 UWG (German Act Against Unfair Competition). The use of the shipping service provider MailChimp, carrying out statistical surveys and analyses as well as logging of the registration procedure, is delivered on the basis of our legitimate interests in accordance with the terms and conditions of the contract. If these rules are not observed, we reserve the right to delete, edit, move or close individual contributions (without prior agreement) or to temporarily or permanently block access to the individual comment areas for individual users. We can also edit the contributions to prevent them from being published. We will indicate such interventions in the comments.
When users leave comments on the blog or other posts, their IP addresses are stored. In addition, we require a valid e-mail address in order to be able to contact the user in the event of serious violations of these rules and in particular in the event of violation of third-party legal interests.
